Schulman Bhattacharya Wins Motion for Summary Judgment and $10.5 Million Judgment in Breach of Commercial Contract Case in New York State Court

Schulman Bhattacharya secured an important victory for its clients, two commercial lending companies, in the New York State Supreme Court, which granted the Firm’s motion for summary judgment and awarded the Firm’s clients a nearly $10.5 million judgment. The Firm’s clients had issued a multimillion-dollar loan to the defendants who had defaulted on their payment obligations. The Firm proceeded to file a motion for summary judgment in lieu of a complaint pursuant to New York law, seeking an immediate judgment against Defendants for the full amount of the loan, as well as the interest that has accrued since the loan’s issuance.

On May 1, 2025, the Honorable Arthur F. Engoron, entered a judgment in favor of the Firm’s clients. The Court agreed with the Firm that the defendants had entered into an “absolute and unconditional” guaranty of payment and that the Firm’s clients were entitled to a judgment of $10.5 million.
